Introduction

The following Terms and Conditions control your membership in My Instant Biz. You agree that you have read and understand this Agreement ("Agreement") and that your membership in the My Instant Biz system (the "System") shall be subject to the following Terms and Conditions between you (the "Member") and My Instant Biz (the "System"). These Terms and Conditions may be modified at any time by My Instant Biz. If and when these terms and conditions are changed, you will receive an email to your email address on file with My Instant Biz. There will also be a notice posted in the private members forum located at http://escalating.biz/forum. Your continued participation in My Instant Bizthe 48 hours after such modification shall be deemed to be your acceptance of any such modification. If you do not agree to these Terms and Conditions, please do not register to become a member of My Instant Biz.

My Instant Biz does not own TrafficWave. Any offers made on this website in behalf of TrafficWave are contingent on the terms of service on the TrafficWave website.

The 60 day free trial offered with your My Instant Biz membership will be the agreement that you sign up for when you join My Instant Biz. Any changes made to said trial will not affect current members.

Terms of Participation

Members must provide My Instant Biz with accurate, complete and updated registration information, including an accurate name and email address.

To the full extent allowed by applicable law, My Instant Biz at its sole discretion and for any or no reason, My Instant Biz may refuse to accept applications for membership.

Members may not (i) select or use a Email Address of another person; (ii) use a name subject to rights of another person without authorization from that person; (iii) use a false or misleading name or email address to activate or use a Member account.

By signing up for the system, Member is opting-in to receive all emails from My Instant Biz. If you do not wish to receive these emails, you may cancel your account anytime .

My Instant Biz reserves the right to track Member's activity by both IP Address as well as individual browser activity.

My Instant Biz has the right, in its sole discretion, to suspend or cancel, at any time and for any or no reason, a Member's membership in and access to the My Instant Biz Website and the My Instant Biz system. You do not earn any money from My Instant Biz. The system is a business building program, not an affiliate program. Any discrepancies in income will need to be taken up with the paying entity.

Member agrees not to abuse his or her membership privileges by acting in a manner inconsistent with this Agreement. Member agrees not to misrepresent him or her self in regards to advertising My Instant Biz. Member agrees not to participate in any fraudulent behavior of any kind while representing My Instant Biz.

My Instant Biz shall be the sole determiner in cases of suspected abuse, fraud, or violation of its rules. Any decision My Instant Biz makes relating to the cancellation of membership shall be final and binding.

Spamming is strictly prohibited. Any spamming done to advertise My Instant Biz will result in immediate termination of your account.

Use of autosurf programs is strictly prohibited with My Instant Biz advertising materials. Do not add any urls from My Instant Biz to any autosurf programs. This will result in termination of your account.

All advertising materials provided to you from My Instant Biz, including the autoresponder letters created to promote My Instant Biz, are the property of My Instant Biz. These materials are all protected by copyright laws. You may not alter any of these materials without the prior written consent from Margaret Albright.

Any advertising materials that Member creates for use with the My Instant Biz system must be accepted and authorized by Margaret Albright prior to it's use to represent Member or My Instant Biz.

Member's discontinued participation in the My Instant Biz system or failure to notify My Instant Biz of any name or email address changes may result in the termination of Member's membership.

Member shall comply with all laws, rules, and regulations that are applicable to Member. Member acknowledges that Member may only participate in the My Instant Biz system if and to the extent that such participation is permitted by such laws, rules, and regulations.

If member objects to any of the Terms and Conditions of this Agreement, or any subsequent modifications to this agreement, or becomes dissatisfied with My Instant Biz, Member's only recourse is to immediately discontinue participation in the My Instant Biz system and properly terminate his or her membership.

Disclaimers

Use of My Instant Biz is not acceptance of a job. You will own your own business. My Instant Biz does not pay anyone for their participation in the system. All income comes from outside sources. You will be under no obligation to continue with My Instant Biz ever and may cancel your membership at any time. My Instant Biz and/or Margaret Albright will not be responsible for your successes or failures. Your entire investment will be at your own risk. There is no guarantee of income associated with the use of My Instant Biz.

MEMBER EXPRESSLY AGREES THAT USE OF THE SERVICE IS AT MEMBER'S SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT ALLOWED BY APPLICABLE LAW, MY INSTANT BIZ EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED BY LAW, CUSTOM OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. MY INSTANT BIZ MAKES NO WARRANTY REGARDING ANY GOODS OR SERVICES PURCHASED OR OBTAINED THROUGH MY INSTANT BIZ OR ANY TRANSACTIONS ENTERED INTO THROUGH MY INSTANT BIZ.

TO THE MAXIMUM EXTENT ALLOWED BY APPLICABLE LAW, NEITHER MY INSTANT BIZ NOR ANY OF ITS MEMBERS, SUBSIDIARIES, PUBLISHERS, SERVICE PROVIDERS, LICENSORS, OFFICERS, DIRECTORS OR EMPLOYEES SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO THIS AGREEMENT, RESULTING FROM THE USE OR THE INABILITY TO USE THE SERVICE OR FOR THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES OR RESULTING FROM ANY GOODS OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH MY INSTANT BIZ OR RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF USER'S TRANSMISSIONS OR DATA, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER INTANGIBLE, EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

To prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, uses appropriate industry standard procedures to safeguard the confidentiality of Member's personal information, such as firewall, encryption, token authentication, application proxies, monitoring technology, and adaptive analysis of the Website's traffic to track abuse of the My Instant Biz Website and its data. However, no data transmitted over the Internet can be 100% secure. As a result, while My Instant Biz strives to protect its Members personal information, My Instant Biz cannot guarantee the security of any information that Members transmit to or from the participating advertisers/merchants and Member does so at his/her own risk.

This Agreement constitutes the entire Agreement between Member and My Instant Biz in connection with general membership in the My Instant Biz system and supersedes all prior agreements between the parties regarding the subject matter contained herein. If any provision of this AGREEMENT is found invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the other provisions of this AGREEMENT will remain in force. No failure of either party to exercise or enforce any of its rights under this AGREEMENT will act as a waiver of such rights.
